Appeal court dismisses ex-CJN’s suit challenging his suspension

The court of appeal Abuja division has struck out suit filed by former chief justice of Nigeria, Justice Walter Onnoghen challenging his suspension from office pending his trial before the code of conduct tribunal.

In a unanimous judgement led by Justice Stephen Adah ruled that the code of conduct tribunal’s ex-parte order breached the former CJN’s right to fair hearing.

Justice Adah who read the judgement, faulted the manner which it was conducted.

He however struck out the matter on the grounds that the substantive matter had been concluded by the CCT which ended in the former CJN’s conviction on charges of false and non-declaration of assets.

President Muhammadu Buhari on the basis of the ex-parte order suspended Onnoghen from office on January 25.
