Ekiti Court Jails 2 For Conspiracy, Assault

An Ekiti State Chief Magistrate Court sitting in Ilawe Ekiti, Ekiti South West Local Government Area of the state has sentenced Lucky Obere and Emmanuel Samson to six years imprisonment each.

According to the charge, the defendant Lucky Obere and Emmanuel Samson were arraigned on two count charge bothering on conspiracy and assault occasioning harm.

The two men reportedly conspired to attack one Alice Samson by stabbing her with Knife on the head, arm and other parts of the body, on November, the 19th 2021 in Ilawe Ekiti, contrary to Sections 516 (A) and 516 of the Criminal Code Cap C16, Laws of Ekiti State, 2012.

In her testimony before the court, Alice Samson said, the 2nd defendant Emmanuel Samson was her former husband with five children, adding that she and her son were on their way on a tricycle to Ipetu Ijesa to see her mother, when they saw the 1st defendant Lucky Obere chasing the tricycle with a Bajaj Motorcycle on the fateful day.

She added that the defendant caught them along Igbara-Odo Ekiti and ran after her son who rode the tricycle to the bush, while shouting for help, she saw her former husband emanated from the bush and started beaten her, in the process he stabbed her with knife on the head, arm and other parts of the body, in presence of Lucky Obere.

Police Prosecutor, Morountonu Adegboyega called three witnesses and tendered extra-judicial statements among others as exhibits to proof his case.

The defendants spoke in their own defence through their counsel and called no witness.

In his ruling, chief Magistrate Olufemi Ayedun said the Prosecution has been able to establish that the two defendants conspired to carry out the attack on Alice Samson. Accordingly, the two defendants are found guilty as charged.

On count one, the accused persons are sentenced to 3 years imprisonment each, the trial magistrate also sentenced them into 3 years imprisonment each without option of fine on count two, the sentences are to run concurrently.
